By accessing or using Offcut ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Offcut is an AI-powered operations manager for creative professionals (photographers, videographers, and content creators). The Service automates client inquiry responses, quote generation, invoice sending, follow-ups, and calendar management.
3. Account Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use
You must be at least 18 years old to use the Service.
4. Subscription and Billing
Offcut offers paid subscription plans (Starter, Pro, Studio). By subscribing, you agree to pay the applicable fees. Founding member pricing is locked for the duration of your continuous subscription.
Subscriptions auto-renew monthly unless cancelled. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
5. 14-Day Money-Back Guarantee
If you are not satisfied with the Service within the first 14 days of your initial subscription, contact us for a full refund. After the 14-day period, no refunds are issued for the current billing cycle.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Send spam, unsolicited communications, or fraudulent content
- Impersonate any person or entity
- Interfere with or disrupt the Service's infrastructure
- Attempt to reverse-engineer or copy the Service
7. AI-Generated Content
The Service uses AI to generate responses and content on your behalf. You are responsible for reviewing AI-generated content before it reaches clients. Offcut does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
9. Intellectual Property
Offcut and its logos, trademarks, and software are the property of Offcut. Content you submit through the Service remains your property. You grant Offcut a limited license to process your content for the purpose of providing the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. OFFCUT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFCUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM.
12. Termination
We reserve the right to suspend or terminate your account for violation of these Terms. You may terminate your account at any time by cancelling your subscription.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration.
